These cameras are designed to capture information about vehicles, including license plates and various vehicle characteristics. Flock says its systems can help law enforcement locate stolen vehicles, find missing people, investigate crimes, and identify vehicles connected to incidents.

According to the company's current information, its network connects agencies across 49 states, and its systems can search vehicle characteristics even when investigators do not have a complete license plate number. 

The technology is different from a traditional security camera.

A normal camera may record a street or parking lot and require an officer to manually watch the footage.

An automated license-plate reader, by contrast, is designed to extract information from passing vehicles and make that information searchable.

That makes the technology potentially very powerful.

It can help investigators answer questions such as:

  • Where was a particular vehicle seen?
  • When did it appear?
  • Did it travel through several locations?
  • Was it near a crime scene?
  • Did it appear on roads used by suspected criminals?
  • Can investigators identify a vehicle even if they only know some of its characteristics?

These capabilities explain why law enforcement agencies have increasingly adopted the technology.

Why Would Flock Cameras Be Used Near the Southern Border?

That is not an accurate description of the basic technology.

However, vehicle surveillance can still become part of immigration enforcement depending on how agencies use the information.

The Connection to Border Patrol

The relationship between license-plate reader networks and federal immigration enforcement has already become a subject of public debate.

The Associated Press has reported on Border Patrol's use of license-plate reader information to monitor travel patterns, including activity far from the physical border. 

That development has raised concerns among privacy advocates.

The argument is that technology originally justified as a tool against smuggling or serious crime can potentially expand into a much broader surveillance system.

Instead of simply looking for one suspect vehicle, authorities may be able to search databases containing information about thousands or millions of vehicles.

That creates an important question:

How much information should the government be allowed to collect about ordinary people's movements?

The Privacy Argument

The strongest criticism concerns privacy.

Imagine driving across southern Texas, Arizona, New Mexico, or California.

You may be going to work.

You may be visiting family.

You may be taking a vacation.

You may be driving to a hospital.

You may have absolutely nothing to do with illegal immigration.

Yet your vehicle could still pass a license-plate reader.

That creates a record showing that your vehicle was at a particular location at a particular time.

Flock Safety says it does not work directly with U.S. Immigration and Customs Enforcement and that ICE does not have direct access to Flock cameras, systems, or data by default. The company says local agencies control access and can decide how information is shared.

The distinction is between the company itself and the government agencies that use its technology.

If a local police agency operates Flock cameras, questions can arise about whether that agency shares information with federal authorities.

Flock has acknowledged that it previously conducted limited pilots involving Customs and Border Protection and Homeland Security Investigations, although the company says it does not currently have contracts with those Department of Homeland Security agencies. 

This is why transparency is so important.

People need to know not only who owns the camera, but also:

  • Who can search the data?
  • Who can receive the information?
  • How long is it stored?
  • Can federal agencies access it?
  • Can other states access it?
  • What rules govern searches?
  • Are searches audited?
  • What happens when someone is incorrectly identified?

What About Wrongful Identification?

No technology is perfect.

License-plate readers can make mistakes.

A camera may misread a plate.

Two vehicles may look similar.

A stolen or cloned license plate may cause investigators to focus on the wrong vehicle.

A vehicle may also be near a suspected crime without having any connection to it.

That means camera information should ideally be treated as an investigative lead, not automatic proof of guilt.

This distinction is essential.

If an automated system says that a vehicle was at a location, that does not automatically prove that the owner committed a crime.

There may be several people who use the same vehicle.

The vehicle may have been sold.

Someone else may have been driving.

The more searchable the data becomes, the more important legal safeguards become.

What Could Responsible Border Surveillance Look Like?

The answer does not necessarily have to be either:

“Install cameras everywhere”

or

“Ban all cameras.”

There may be a middle ground.

A responsible system could include strict rules about how surveillance information is collected and used.

For example:

Limited Data Retention

Information that is not relevant to an investigation should not necessarily be stored indefinitely.

Flock says it has reduced its default data-retention period to seven days for certain systems, although actual retention can depend on customer policies and applicable rules. 

Strict Access Controls

Only authorized officers should be able to search the system.

Search Auditing

Every search should be logged and reviewable.

Flock says its platform includes audit logs for searches. 

Clear Legal Standards

Authorities should have clear rules defining when surveillance information can be searched for immigration purposes.

Public Transparency

Communities should know where cameras are located and which agencies can access the information.

Independent Oversight

There should be mechanisms for investigating misuse.

These safeguards would not eliminate every concern, but they could reduce the risk of abuse.

Is More Surveillance Worth It?

This ultimately depends on what Americans believe the government should be allowed to do in the name of border security.

If the primary objective is stopping organized smuggling and trafficking, supporters argue that surveillance technology is a reasonable tool.

If the technology can help identify criminal networks and protect vulnerable migrants from smugglers, that could be a significant benefit.

“Do you support Flock cameras?”
